Environment Agency publishes timeline for phasing out T8 waste exemption for end-of-life tyres

Waste tyre treatment operators face an April 2027 permitting deadline, subject to parliamentary approval

The Environment Agency of England and Wales (EA) has published detailed plans to significantly alter the waste management landscape, including a relatively short phasing out period for the T8 exemption for mechanically treating end-of-life tyres (ELTs). The withdrawal of the exemption will require operators to transition to full environmental permits. The withdrawal of the T8 exemption represents a hard-won victory for the UK’s Tyre Recovery Association and its members, who have campaigned for around a decade for the exemption’s removal. The EA discussed this impending regulatory change at the TRA’s Briefing Day 2026 in August.

According to the guidance, which was updated on 21 October 2026, the Department for Environment, Food and Rural Affairs (Defra) and the EA have outlined a strict timeline for the upcoming regulatory changes, which are subject to parliamentary approval expected before 17 December 2026:

  • 6 January 2027: The new waste exemption rules officially come into force.
  • 6 April 2027: The three-month transition period for the T8 exemption expires. From this date, the T8 exemption will be officially withdrawn, and operators can no longer rely on it to carry out mechanical treatment of end-of-life tyres unless formal steps have been taken.

Conditions and requirements for operators

To successfully navigate the transition away from the T8 exemption and continue business legally, tyre treatment facilities must meet specific conditions set out by the Environment Agency:

Mandatory Permit Application: Operators currently utilizing the T8 exemption must apply for a waste environmental permit before the 6 April 2027 deadline.

Interim Continuity: Businesses are permitted to continue their current operations under the existing exemption while their formal permit application is actively being processed by the Environment Agency, provided the application is submitted before the April deadline.

Cease Operations if Non-Compliant: If an operator cannot or chooses not to apply for a full environmental permit by 6 April 2027, they are legally required to completely cease all mechanical end-of-life tyre treatment activities previously covered by the T8 exemption.

Site-Specific Rules & Multi-Exemption Limits: Operators must also review whether they hold multiple exemptions at the same site. Under the broader reforms, from 6 July 2027, combined storage limits across multiple exemptions will be capped at the lowest limit among them. Furthermore, if the site has a “technical connection” to an existing permitted facility that increases overall environmental risk, businesses may need to integrate their operations into a single permit structure.

Industry stakeholders are urged to review their current registrations on the public register immediately and liaise with the Environment Agency to ensure timely permit applications before the April cut-off.
